James C. Otteson
Founding Partner
Jim Otteson is the founder of Agility IP Law, a law firm dedicated to the delivery of the highest quality intellectual property litigation services in an efficient and cost-effective manner. He has over 18 years of experience in intellectual property litigation, including patent, copyright, trade secret and trademark cases in state and federal courts, as well as in the U.S. International Trade Commission (ITC). Before founding Agility IP Law in January 2010, Jim was the Head of ITC Litigation at the Silicon Valley law firm of Wilson Sonsini Goodrich & Rosati, where he practiced starting in August 1992. He also served as a judicial clerk to the Hon. Byron J. Johnson of the Idaho Supreme Court (1991-92).
Michelle G. Breit
Partner
Michelle Breit joined Agility IP Law in September 2011 as a partner. During over 20 years of practice, Michelle has represented companies and individuals, in state and federal courts and before the United States International Trade Commission, in complex intellectual property litigation, including in patent, copyright and trademark infringement actions, as well as cases involving claims of trade secret misappropriation and breach of confidentiality agreements. Michelle has represented clients in diverse technologies, including satellite communications and signal processing, semiconductor design and fabrication, and fire protection devices. Michelle has successfully taken clients through mediation and arbitration, temporary restraining orders and preliminary injunction hearings, summary judgment and trial.
David A. Caine
Partner
David A. Caine joined Agility IP Law in February 2011 as a Partner. In over nine years of practice, he has handled numerous complex, high stakes intellectual property and commercial matters. He has represented U.S. and foreign clients in federal and state courts, as well as in arbitration. His cases have involved a wide spectrum of technologies, including semiconductor fabrication, semiconductor packaging, computer hardware, computer software, memory and logic circuits, medical devices and telecommunications. David has substantial experience managing cases, formulating and directing case strategy, developing technical claims and defenses, executing fact and expert discovery, and preparing cases for trial. He has argued numerous motions, and has examined witnesses at hearings, bench and jury trials. Before joining Agility, David was an associate at Wilson Sonsini Goodrich & Rosati.
Thomas T. Carmack
Partner
Thomas T. Carmack joined Agility IP Law in March 2011 as a Partner. Since 2003, he has represented domestic and foreign high technology companies in state and federal courts, and the U.S. International Trade Commission. His practice has included all aspects of patent, trade secret and complex commercial matters involving computer hardware and software, life sciences, pharmaceuticals, semiconductor fabrication, electronic security, memory and logic circuits and design patents. Thomas has significant trial experience, including witness examination, and has argued numerous motions in both state and federal court. Before joining Agility, Thomas was an associate at Wilson Sonsini Goodrich & Rosati.
Philip W. Marsh
Partner
Philip Marsh joined Agility IP Law in September 2011 as a partner. Mr. Marsh comes to Agility with more than thirteen years of intellectual property experience, including high-stakes patent litigation experience across a variety of technologies, such as computer hardware and software, semiconductor fabrication and devices, wireless telecommunications, optical computer storage media, solid-state memory devices, fiber optics, lasers, and optical amplifiers. In addition to patent litigation experience, Mr. Marsh has significant prior experience preparing and prosecuting patent applications directed to electrical, computer, and mechanical inventions, as well as advising clients regarding strategic patent portfolio analysis and development. He also has experience litigating trade secret, copyright, and trademark issues.

Xiang Long is Of Counsel at Agility IP Law. Xiang's background encompasses several years of experience in intellectual property litigation, including patent and trade secret cases in state and federal courts, as well as in the U.S. International Trade Commission (ITC). Before joining Agility IP Law in May 2010, Xiang was an associate at the Silicon Valley law firm of Wilson Sonsini Goodrich & Rosati.
Vincent Kenman Yee
Director of Ops/ Sr. Case Manager
Vincent is the Director of Ops/Senior Case Manager at Agility IP Law. Vincent's background encompasses over 25 years of legal managerial/paralegal experience in intellectual property litigation. Before joining Agility IP Law, Vincent worked for 7 years as Director of Litigation Administration at Broadcom Corporation. He managed all aspects of in-house electronic document collection and discovery for a series of large patent infringement cases between Broadcom and Qualcomm.
Wei Yuan
Technical Specialist
Wei Yuan is Technical Specialist at Agility IP Law. He concentrates on conducting technical analysis and providing technical support for Intellectual Property litigation, including patent analysis, prior art search, and infringement analysis. Before joining Agility IP Law, Wei was a researching assistant in the City University of New York, where he focused on the cerebral vascular biology.
