Nutritional Supplements
The nutritional supplement industry generates many important innovations that improve our health and wellness. In contrast to the pharmaceutical industry, most of these improvements in formulas and processes are not subject to FDA approval. Thus, the assertion of patents in this area normally falls outside the requirements of the Hatch-Waxman Act. Nevertheless, patents can be important tools to create, protect and enhance market share in this lucrative field.
Agility IP Law has valuable experience in patent litigation involving nutritional supplements. In 2009, Jim Otteson defended Chinese company Nantong Foreign Trade (NFT) in a case brought by Cargill in the ITC. Cargill sought the exclusion of NFT's vegan glucosamine from importation into the United States. After persuading Cargill that it might lose its patent, Mr. Otteson was able to convince Cargill to drop its case without any payment by NFT.
