Agility IP Law Founder Jim Otteson Named Among the Top 75 Intellectual Property Litigators in California
SAN FRANCISCO (April 7, 2010) - Agility IP Law founder and lead attorney Jim Otteson was named among the Top 75 Intellectual Property Litigators in California by the San Francisco / Los Angeles Daily Journal.
Mr. Otteson previously served as the Head of ITC Litigation at the Silicon Valley firm of Wilson Sonsini Goodrich & Rosati, where he practiced since 1992. Jim left WSGR on good terms in January 2010 to launch his own IP litigation firm, which shares space with Bergeson, LLP in San Jose, California.
The Daily Journal cited two significant victories for Otteson over the last year, including last summer’s dismissal of an International Trade Commission investigation brought by Cargill, Inc. to block imports of the nutritional supplement glucosamine by a Chinese company, Nantong Foreign Trades and health Medicines Co., Ltd. (NFT). After developments in the case that potentially threatened the validity of Cargill’s asserted patent, Cargill voluntarily requested the withdrawal of its ITC complaint. As a result, the ITC terminated the investigation without any payment by NFT.
Also noted was Mr. Otteson’s recent Federal Circuit victory for Crocs, Inc., in which the court overturned an earlier ITC ruling. The Federal Circuit ruled that Crocs’s patents were valid, and concluded that several competitors infringed patents for the company’s signature clogs. The matter was sent back to the ITC for a possible general exclusion order that could exclude all infringing shoes from being imported into the country.
Mr. Otteson has particular expertise in the litigation and trial of complex patent cases, especially in the ITC. He has tried multiple ITC cases for both respondents and complainants and has litigated scores of other patent and intellectual property cases. Mr. Otteson’s litigation base spans a broad range of technologies including semiconductors, semiconductor packaging, computer hardware and software, nutritional supplements, biomedical devices, Internet and e-commerce and consumer electronics.
