In re Certain CD-ROM Controllers and Products Containing Same II, ITC Inv. No. 337-TA-409 (1998-2001).
Jim Otteson represented respondents United Microelectronics Corporation, MediaTek, Inc., Lite-On Technology Corporation, and AOpen, Inc. in an action brought by complainant Oak Technology, Inc. concerning Oak's allegations that respondents imported CD-ROM decoder chips that allegedly infringed U.S. Patent No. 5,581,715. After a three-week trial, the respondents obtained a completely favorable Initial Determination from the Administrative Law Judge, who found the patent to be invalid and not infringed, as well as unenforceable due to Oak's inequitable conduct. The Commission affirmed the finding of noninfringement. Mr. Otteson later argued Oak's appeal before the Federal Circuit, which affirmed finding of noninfringement in Oak Technology, Inc. v. International Trade Com'n, 248 F.3d 1316 (Fed. Cir. 2001).
